Terms of Use

This Agreement ("Agreement") is a legally binding contract made as of the Reservation Date below by and between the undersigned person(s) or company ("Guest") and Ozzy Cozy Stays Ltd, the undersigned owner, manager, or agent ("Rental Agent"), regarding the rental of the residence described below ("Property") for the duration of the Rental Term for the Total Rental Fee and other considerations as outlined herein.

1. Occupancy

Guest agrees that no more than the specified number of persons in the booking confirmation shall occupy the Property at any time during the Rental Term. All occupants shall comply with the conditions and restrictions of this Agreement.

2. Condition and Use of Property

The Property is provided "as is." The Rental Agent will use reasonable efforts to ensure that all amenities are operational, such as internet access, TV services, or hot tubs. However, the Rental Agent is not liable for any failure of these amenities but will endeavor to address reported issues promptly. The Guest acknowledges that the use of certain amenities (e.g., hot tubs, pools, fireplaces) involves inherent risks and agrees to use these amenities responsibly and at their own risk. The Property is for residential purposes only. The Guest must maintain the Property in a clean and sanitary condition, refrain from loud noise, and avoid disturbing neighbors. The Guest must not use the Property for any unlawful, offensive, or otherwise improper activities.

3. Default

Failure to comply with the terms of this Agreement will result in the Guest being required to vacate the Property immediately. No refunds will be issued, and the Guest may be liable for additional costs, including legal fees if applicable.

4. Assignment or Sublease

The Guest shall not assign or sublease the Property or allow its use by anyone not included in the booking without prior written consent from the Rental Agent.

5. Risk of Loss and Indemnification

All personal property brought onto the Property by the Guest is at the Guest's sole risk. The Rental Agent is not responsible for any loss or damage to personal items. The Guest agrees to indemnify and hold harmless the Rental Agent, its owners, agents, and employees from any claims arising from the Guest's stay, including but not limited to damages, injuries, or loss of life.

6. Release

The Guest releases the Rental Agent and its representatives from any claims related to injuries or death that may occur on or near the Property. The Guest agrees that use of the Property and its amenities is entirely at the Guest's risk.

7. Entry and Inspection

The Rental Agent reserves the right to enter the Property at reasonable times, with prior notice, for inspection, maintenance, or to show the Property. In emergencies or if there is a belief of imminent danger, the Rental Agent may enter without notice.

8. Unavailability of Property If the Property becomes unavailable during the Rental Term due to unforeseen circumstances, the Rental Agent will attempt to provide a comparable replacement. If no suitable replacement is available, all payments will be refunded, and the Agreement will be terminated without further liability.

9. Additional Terms

1.1. You must be 18 years or older to book.

1.2. We reserve the right to refuse bookings.

1.3. Check-in is after 3 PM, and check-out is by 10 AM unless otherwise agreed. Late arrivals after midnight without prior notice may be treated as a cancellation.

1.4. Exceeding the allowed occupancy is a breach of Health and Safety Regulations and may result in eviction or additional charges.

1.5. Non-payment may result in cancellation, forfeiting any deposits.

1.6. A credit card is required for damages. Charges may apply if conditions are not met, including excessive cleaning or lost keys.

1.7. The apartment must be left in a reasonable state. Excessive cleaning may incur additional charges.

1.8. Evidence of smoking inside the apartment will incur a £100 cleaning fee.

1.9. Cancellation within 30 days of arrival may incur the full reservation fee.

2.0. Lost keys must be reported immediately. Lock replacement costs will be charged to the Guest.

2.1. The Rental Agent reserves the right to verify guest identification upon check-in.

10. General Provisions

This Agreement constitutes the entire agreement between the parties. Any amendments must be in writing and signed by both parties. This Agreement is governed by the laws of the United Kingdom. Disputes will be resolved through mediation or arbitration before any legal action. The waiver of any breach does not constitute a waiver of subsequent breaches. Invalid provisions do not affect the remainder of the Agreement. Notices must be in writing and delivered to the addresses provided.
